Can foreigners buy land in Mallorca?

Foreign buyers can purchase land in Mallorca. Buyers will normally require an NIE identification number and should use an independent lawyer to complete the legal checks and purchase process.

Can I build a house on any plot in Mallorca?

No. The ability to build depends on the classification of the land, the applicable planning regulations, the municipality and the individual characteristics of the plot. A planning assessment should be obtained before buying.

What is the difference between urban and rustic land?

Urban land is generally located within a developed area and may have access to infrastructure and defined building parameters. Rustic land is located in the countryside and is subject to different and often more restrictive planning rules.

Is a plot with a project the same as a plot with a building licence?

No. A project may still be awaiting approval. A building licence indicates that permission has been granted, although its validity, conditions and deadlines must still be checked.

Is it better to buy a plot with a licence?

A valid licence can reduce part of the planning uncertainty and may allow construction to begin sooner. However, the approved design may not completely match the buyer’s requirements, and all documentation should be reviewed before purchase.

How long does it take to obtain a building licence in Mallorca?

Timescales vary considerably depending on the municipality, land classification, complexity of the project and administrative workload. An architect familiar with the relevant town hall should provide an assessment based on the individual plot.

What additional costs should I consider?

In addition to the purchase price, buyers should allow for taxes, legal fees, notary and registration costs, architectural services, surveys, licence fees, site preparation, utility connections and construction costs.
